Washington is writing checks for nuclear with one hand and reserving the right to claw back PJM's money with the other — and the AI power trade is only priced for the first hand.
The Big Shift
Overnight FERC opened a Section 206 proceeding against PJM and set a refund effective date — regulator-speak for "we think one of your rates may be unjust, and any fix can reach back to this date" (1). The notice doesn't say which rate or how much, so this is an overhang, not a number. It matters because PJM is where the AI power trade lives: it hosts the Susquehanna, Calvert Cliffs and Beaver Valley-type assets whose capacity payments and bilateral deals underwrite the whole "sell power to hyperscalers" thesis. What it signals: the predictability premium investors have been paying for PJM cash flows is now a question mark, and the same federal government that's funding this build-out can also reprice it.
Analysis
Two-sided policy risk is the new regime. Yesterday DOE agreed to lend Vistra up to $4.2B to upgrade and uprate three nuclear plants in Ohio and Pennsylvania — signed, not just announced, per the 10/05 8-K (2). Today FERC opens a rate case against the market those plants sell into. That's the cross-domain thread hardening: the state has become the build-out's banker, and a banker both funds and sets terms. Practical read — names with cheap federal debt *and* contracted offtake (VST, CEG) absorb this; names with thin interest coverage and a deal already sitting at FERC (TLN) do not. That's why CEG holds flat and TLN steps down.
Demand-side confirmation keeps arriving, and it's structural, not spot. Google's new deal with Constellation funds capacity uprates through a subscription-style program — effectively paying for more output from existing reactors rather than waiting a decade for new ones (3); Amazon signed a 20-year PPA at the 1,790-MW Calvert Cliffs plant (4). Both are "squeeze more from what exists" moves, which tells you new build is still too slow. The quieter version of the same story: MISO, SPP and PJM are trying again to replace a 2004 snapshot of their systems that still governs who holds firm rights on transmission lines (5). Who gets to move power, not who generates it, is becoming the binding constraint.
The compute thread cuts both ways and is still unconfirmed. Two claims landed overnight, both from forums (treat as leads, not facts). Microsoft reportedly confirmed OpenAI uses "Looped Transformers" in the GPT-6 line — the model runs the same layers more than once per answer, with GPT-6.1 Sol doing two inference passes (6). That means *more* electricity per answer. Pointing the other way: a 0.8B-parameter model reportedly beat a 2B model on a reasoning benchmark using closed-form math to copy a bigger model's behavior, no training run required (7). If cheap distillation wins, power demand flattens and Own-the-Bottleneck breaks. If looped inference wins, demand per query goes *up*. No conviction move until this shows up in a T1/T2 source — a capex guide, a chip roadmap, a disclosed serving cost.
Capital is routing around equity, which is good news until GPU resale values are tested. GPU-backed equipment loans are now funding through asset-backed securities — bonds secured by the hardware itself (8). Alongside it: a Forum Markets/Edge Node JV taking capacity in Dallas and North Carolina (9), and Applied Digital finishing a second building to reach 250MW in North Dakota (10). For WULF this is the non-dilutive channel the thesis needs. The embedded assumption is that a three-year-old GPU still has collateral value — the first ABS deal that prices wide will tell you whether lenders believe that. Note also that concentration risk is real on both sides of the Pacific: ByteDance alone occupies a fifth of China's data center capacity, mostly leased (11).
Materials and energy prices are the slow leak under all of it. Copper is at a record price, yet copper miners' equities sold off in the top-50 ranking's second-worst month on record (12) — the market is betting high prices won't persist, while the World Bank puts $1.4B behind Codelco as a template for state-owned miners raising private capital (13) and Greenland clears the Tanbreez heavy rare earth project (14). Transformers, switchgear and cable are copper-intensive; a sustained price move shows up as longer lead times and higher interconnection costs 18 months out, which is exactly when these data centers want to energize. On top of that, renewed attacks on shipping around the Strait of Hormuz (15) and Ukraine's explicit campaign against Russian oil revenue (16) put a floor under global fuel prices — which raises the marginal cost of gas-fired generation and makes the nuclear PPAs above look better in hindsight, not worse.
What Would Prove Us Wrong
- The PJM docket turns out to be narrow and prospective-only. If the filings today show FERC targeting a small administrative charge with no retroactive exposure, the TLN downgrade (0.42 → 0.38) was wrong and should snap back. Measure: scope of the rate at issue and whether complainants ask for refunds from the effective date. Read the docket before the open.
- A T1/T2 source confirms real efficiency gains per answer. Concretely: a hyperscaler cutting 2027 capex guidance, a disclosed drop in cost-per-million-tokens of 50%+ without a price cut, or a signed PPA being renegotiated down. That hits Own-the-Bottleneck pillar 1 directly — the overnight distillation claim is only a rumor until one of these appears.
- GPU-backed ABS prices wide or a deal gets pulled. If the Stonebriar/Wingspire-style paper struggles to clear, the non-dilutive financing channel closes and WULF pillar 3 breaks — back to equity issuance at a worse price. Measure: spread at pricing versus comparable equipment ABS, and whether a second wave of issuers follows this month.
Thesis Impact
- CEG | Conviction: HOLD | Surprise: MED | FERC opened a Section 206 proceeding against PJM with a refund effective date — meaning FERC thinks some PJM rate may be unjust and can claw back from that date. Scope isn't stated in the notice, so treat as a new overhang on PJM revenue, not yet a number. CONTRADICTS the "PJM prints are predictable" part of the prior; offset by the Google uprate-subscription deal and the Amazon Calvert Cliffs 20-yr PPA, which CONFIRM pillar 2. Net flat at 0.88, but read the docket today. | 1
- TLN | Conviction: DOWN | Surprise: MED | Same PJM 206 proceeding, no offset. Susquehanna sits in PJM, the AWS PPA is ~35% of gross margin, interest coverage is thin, and the Cornerstone deal is already waiting on FERC. A retroactive PJM rate change hits this balance sheet harder than any peer's. CONTRADICTS pillar 2 (clean post-FERC transition). 0.42 → 0.38. | 1
- VST | Conviction: HOLD | Surprise: LOW | DOE will lend up to $4.2B for uprates at three Ohio/Pennsylvania nuclear plants — recurring 1d, and the 10/05 8-K (material agreement + material debt) confirms it's signed, not announced. CONFIRMS pillar 4 (uprates add low-cost capacity) and funds it with cheap federal debt. Already in the 0.82. | [source](//www.rtoinsider.com/147440-doe-to-loan-vistra-nuclear-plant-upgrades/)
- Own-the-Bottleneck | Conviction: HOLD | Surprise: MED | Two T3 claims touch the one trigger that would break this: a 0.8B model beating a 2B on ARC-Challenge via zero-backprop weight transfer, and Microsoft confirming OpenAI uses Looped Transformers in GPT-6. These cut opposite ways — distillation-style efficiency would flatten power demand, but looped inference (GPT-6.1 Sol = 2 passes) means *more* compute per token. T3, so LEADS ONLY: no conviction move without T1/T2. Would CONTRADICT pillar 1 if corroborated. | 7
- WULF | Conviction: HOLD | Surprise: LOW | GPU-backed equipment loans are now funding through the ABS market (Stonebriar, Wingspire) — a non-dilutive financing channel for buildouts, which CONFIRMS pillar 3. Recurring 1d, so already priced. The 10/05 8-K ("other material event") is unread content on a name where hosting-contract news is the whole thesis — check it before the open. | 8

QA & Caveats
- CEG: The claim about the scope of the FERC notice is an interpretation; treat it as a new overhang rather than a fixed number.
- TLN: The impact on the balance sheet is a projection; the source confirms the rate change exists, but not the exact financial consequence for this specific entity.
- Own-the-Bottleneck: The call correctly identifies the need for T1/T2 data before making a conviction move based on T3 sources.
- WULF: The thesis that GPU financing is filtering into ABS is supported by the source; the observation that it is "already priced" aligns with the context.
