Morning Analysis — 2026-10-15

Dek

America is turning away data centers one state at a time, and the AI buildout is moving to the states that still say yes.

The Big Shift

A Virginia state senator has proposed a three-year pause on new data centers across the state (1). Virginia is the biggest data center market in the country. Oregon has already frozen data center permits until July 2027, so this is no longer a one-off. Saying no is becoming normal politics. Expect AI demand to shift toward Texas, the Southeast and the Plains. That raises the value of power and land in welcoming states and lowers the certainty of growth in Northern Virginia.

Analysis

Power demand is real, but politics now decides where it goes. EIA data shows PJM (the Mid-Atlantic grid), ERCOT (Texas) and SWPP (the central Plains) all set records for peak hourly load this summer (2). That confirms the core idea that electricity is the scarce input for AI. But permission to use that power is getting harder to win. Oregon paused air and water permits (3). California regulators have delayed a vote on a large Google site in San Jose for the fourth month in a row (4). The backlash has also reached Washington's permitting-reform debate ahead of the midterms (5). Implication: Own-the-Bottleneck still holds, but the bottleneck now includes "a state willing to say yes," not just megawatts. Grid-equipment names that sell into every region (PWR, ETN) are better protected than any single power market.

CEG carries the most exposure to Virginia. Data center load in Northern Virginia is a big reason PJM capacity prices are high. (Capacity prices are what the grid pays plants to be available when demand peaks.) A statewide pause would cut directly into that growth story. For now it is one senator's proposal with no co-sponsors and no committee vote. CEG's nuclear deals still add value, as Google's agreement to uprate (boost the output of) 11 reactors shows (6). Implication: hold, but a 0.95 conviction prices in almost no political risk. If the pause gains backing, trim.

Copper's supply scares look bad up close but don't settle the bigger question. BHP avoided a strike at Escondida, the world's largest copper mine (7). An avalanche at Codelco's El Teniente mine killed two workers and adds to Chile's supply worries (8). But the ICSG, the industry's statistics body, expects the global surplus to more than triple by 2027 as new smelters start up (9). About 1.5 million tonnes of copper stockpiled in the US to get ahead of tariffs could stay stuck there past January 1 (10). Implication: the "structural deficit" idea is losing support. SCCO at 0.85 and FCX at 0.49 rest on the same deficit pillar, and the gap between them needs explaining today.

Grid stress has a second, distributed answer. In California, over 85,000 Tesla Powerwall owners sent more than 600 MW to the grid on October 6, most of a record 745 MW dispatch from home batteries (11). Separately, more solar and battery capacity is waiting to connect to the US grid than the entire remaining coal fleet (12). That second point comes from a Reddit post, so treat it as a lead, not proof. Implication: the scarce thing is the connection to the grid, not the power plant. That supports the companies that build wires and substations (PWR, MTZ) (13). It also shows homes and batteries can absorb some peak demand, which caps how high scarcity prices can go.

Geopolitics adds risk at both ends of the AI supply chain. Oil fell even with tanker attacks near the Strait of Hormuz, on reports that the US may ease sanctions (14). Markets are betting the crisis is calming down. TSMC sold off after its third-quarter results, and analysts disagree on whether the stock has peaked (15, 16). Meanwhile Taiwan keeps hardening its defenses: Shield AI delivered its first V-BAT drone to the Taiwan Coast Guard (17), and Tesla won a 1 GWh grid battery order there (18). Implication: the TSMC selloff tests whether chip spending is slowing. If spending is slowing, the power and grid theses lose their demand driver. Read TSMC's capex guidance closely before treating the drop as noise.
